This Privacy Policy explains how ZynAlgo Global LLC collects, uses, discloses, and safeguards your personal information, and describes your privacy rights. It should be read together with our Terms of Service and Cookie Policy. If you do not agree with this Policy, please do not use the Services.

1. Introduction and scope

This Privacy Policy (the "Policy") describes how ZynAlgo Global LLC, a Wyoming limited liability company ("ZynAlgo," the "Company," "we," "us," or "our"), collects, uses, discloses, and protects personal information in connection with the websites, applications, software, and services offered under the ZynAlgo and IndicatorAssets brands, including zynalgo.com, app.zynalgo.com, indicatorassets.com, zynalgo.net, and zynassets.com (collectively, the "Services").

This Policy applies to visitors, registered users, customers, affiliates, and community participants worldwide. For the purposes of the European Union and United Kingdom General Data Protection Regulation (the "GDPR"), ZynAlgo is the "controller" of your personal information. Capitalized terms not defined in this Policy have the meaning given in our Terms of Service.

2. Definitions

  • "Personal Information" (or "personal data") means information that identifies, relates to, or could reasonably be linked with a particular individual or household.
  • "Processing" means any operation performed on Personal Information, such as collection, use, storage, disclosure, or deletion.
  • "Sensitive Information" means categories of data treated as sensitive under applicable law, such as government identifiers, precise geolocation, or financial-account details.
  • "Processor" (or "service provider") means a third party that processes Personal Information on our behalf and under our instructions.

3. Information we collect

3.1 Information you provide to us

  • Identity and account data: name, username, email address, country of residence, age or date-of-birth confirmation, and password (stored in hashed form).
  • Billing and transaction data: billing name and address, plan selected, order history, invoices, and limited payment metadata (such as the payment method identifier, card brand/type, expiration date, and the last four digits of the card). We do not store full payment-card numbers; card data is tokenized and processed by Stripe. For cryptocurrency payments, we may process wallet or transaction identifiers as required to confirm payment.
  • Trading platform identifiers: TradingView, MT4, MT5, and NinjaTrader usernames or account identifiers that you provide so we can provision and enforce your License.
  • Communications: the content of support tickets, emails, chat messages, and conversations with our AI support assistant.
  • Affiliate data: payout details, tax information you provide, and referral activity.
  • Community data: your Discord or Telegram handle and any content you post in our community channels.
  • Preferences: marketing and communication preferences.

3.2 Information we collect automatically

  • Device and technical data: IP address, device and browser identifiers, operating system, language, and time-zone settings.
  • Usage data: pages and features viewed, actions taken, session duration, and referring URLs.
  • Cookies and similar technologies: as described in our Cookie Policy.
  • Log, security, and audit data: access logs, authentication and login events, and audit trails used for security and enforcement.
  • Approximate location: derived from your IP address (we do not collect precise GPS location).

3.3 Information we receive from third parties

  • Payment processors (such as Stripe) and, for cryptocurrency, publicly available blockchain data.
  • Analytics and advertising partners that help us understand and promote the Services.
  • Affiliate and attribution partners (applying last-click attribution with a 180-day cookie window).
  • Fraud-prevention, identity-verification, and sanctions-screening providers.
  • Community platforms (Discord, Telegram) when you interact with our channels.

4. How we use your information

We use Personal Information for the following purposes:

  • to provide, operate, maintain, and improve the Services and to deliver and provision your Licenses;
  • to process payments, subscriptions, renewals, refunds where applicable, and affiliate payouts;
  • to authenticate accounts and enforce our licensing rule of one License per natural person per Account;
  • to provide customer support and to operate our AI support assistant;
  • to detect, prevent, and investigate fraud, piracy, account sharing, abuse, and security incidents;
  • to comply with legal, tax, accounting, sanctions, and export-control obligations, and to respond to lawful requests;
  • to send transactional and service communications;
  • to send marketing communications where permitted, subject to your right to opt out;
  • to analyze usage and improve the security, performance, and features of the Services; and
  • to establish, exercise, or defend legal claims, and to enforce our Terms and policies.

If you are located in the EEA or the UK, we process your Personal Information on the following legal bases:

  • Performance of a contract: to provide the Services, Licenses, billing, and support you request.
  • Legitimate interests: to secure the Services, prevent fraud and piracy, improve our products, market to existing customers, enforce our Terms, and establish or defend legal claims, balanced against your rights and freedoms.
  • Consent: for certain cookies, optional features, and marketing where required by law. You may withdraw consent at any time without affecting prior processing.
  • Legal obligation: to meet tax, accounting, sanctions, and other legal requirements.

6. Cookies and similar technologies

We use essential cookies that are always active (for session management, login, security, and fraud prevention) and, subject to consent where required, analytics, advertising, remarketing, and affiliate cookies. You can manage your preferences as described in our Cookie Policy, which forms part of this Policy.

7. How and with whom we share information

We do not sell your Personal Information for monetary consideration. We disclose Personal Information only as described below:

  • Service providers and processors: hosting, payment, email, analytics, security, customer-support, and AI-service providers that process data on our behalf under contract.
  • Payment processors: Stripe for card payments; for cryptocurrency, transaction details are recorded on a public blockchain outside our control.
  • Third-Party Platforms: TradingView, MT4, MT5, and NinjaTrader, where necessary to provision your License.
  • Community platforms: Discord and Telegram, according to your interactions and their own privacy practices.
  • Affiliate and attribution partners: to operate and account for the affiliate program.
  • Professional advisors: lawyers, accountants, auditors, and insurers, as needed.
  • Authorities and other parties: where required by law, to enforce our Terms, to comply with sanctions and export controls, or to protect the rights, safety, and property of ZynAlgo, our users, or the public, including for fraud investigation.
  • Business transfers: to an acquirer or successor in connection with a merger, acquisition, financing, reorganization, or sale of assets.
  • With your consent or at your direction.

Some disclosures for cross-context behavioral advertising through advertising cookies may be treated as "sharing" under certain U.S. state laws. You may opt out as described in Section 13.

8. Sub-processors and third-party services

We rely on vetted third parties to operate the Services, including Stripe (payments); Discord and Telegram (community); GoHighLevel (CRM and marketing automation); Chatwoot (customer-support messaging); Resend (transactional and marketing email); Cloudflare (content delivery, security, and bot mitigation); Google Analytics, Google Ads, and the Meta Pixel (analytics and advertising); the Third-Party Platforms noted above; and the AI service provider(s) that power our AI support assistant. Each processes data under its own terms, and we maintain contractual data-protection commitments with our processors. 9. AI support and automated processing

Our AI support assistant may process the content of your queries together with relevant account context to generate responses. AI outputs may be inaccurate and do not constitute professional or financial advice. We may use third-party AI providers, and conversations may be logged for quality, safety, audit, and abuse-prevention purposes.

We do not make decisions producing legal or similarly significant effects about you based solely on automated processing without a lawful basis. Where an automated decision with such effect occurs (for example, automated blocking of a suspected fraudulent transaction), you may request human review by contacting [email protected].

10. International data transfers

We operate globally and may transfer, store, and process your Personal Information in the United States and other countries whose data-protection laws may differ from those of your country. Where we transfer Personal Information from the EEA, the UK, or Switzerland to a country not deemed to provide an adequate level of protection, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses (together with the UK International Data Transfer Addendum) or another lawful transfer mechanism. 11. Data retention

We retain Personal Information for as long as necessary to provide the Services and to fulfil the purposes described in this Policy, and thereafter for legitimate business and legal purposes. As a general standard, we retain records for up to seven (7) years, and longer where required for legal, tax, accounting, fraud-prevention, sanctions, dispute, or legal-hold purposes. Representative retention periods include:

  • Account and License data: for the life of the Account, plus the applicable retention period.
  • Billing and tax records: as required by law, generally up to seven (7) years or longer.
  • Support and AI conversations: for service, quality-assurance, and audit purposes.
  • Security, audit, and fraud logs: for as long as needed for security, enforcement, and legal defense.
  • Marketing data: until you opt out or as otherwise required.

When Personal Information is no longer needed, we delete, de-identify, or anonymize it.

12. Data security

We implement appropriate technical and organizational measures designed to protect Personal Information, including access controls, encryption of data in transit, tokenization of payment-card data by Stripe, monitoring, and audit logging. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your credentials confidential and for any activity under your Account.

13. Your privacy rights

13.1 EEA, UK, and Switzerland

Subject to applicable law, you may exercise the rights to access, rectify, erase, restrict, and port your Personal Information; to object to processing (including direct marketing and processing based on legitimate interests); and to withdraw consent. You also have the right to lodge a complaint with your local supervisory authority.

13.2 California (CCPA/CPRA)

California residents may request to know and access the categories and specific pieces of Personal Information we collect, to delete and correct their Personal Information, to opt out of the "sale" or "sharing" of Personal Information, and to limit the use of Sensitive Information. We do not sell Personal Information for money. We may "share" Personal Information for cross-context behavioral advertising through cookies, which you may opt out of. We will not discriminate against you for exercising your rights, and authorized agents may submit requests on your behalf.

13.3 Other U.S. states

Residents of states such as Virginia, Colorado, Connecticut, Utah, and others with comprehensive privacy laws may have rights to access, delete, correct, and obtain a portable copy of their Personal Information, and to opt out of targeted advertising, sale, and certain profiling, together with a right to appeal our decision.

13.4 How to exercise your rights

To exercise any right, email [email protected]. We will verify your identity before responding and will reply within the timeframes required by applicable law. There is no fee unless a request is manifestly unfounded, excessive, or repetitive, as permitted by law.

14. Sensitive information

We do not seek to collect Sensitive Information except where necessary to provide the Services or comply with law. Please do not submit Sensitive Information through support channels unless required. Where we process Sensitive Information, we do so under an appropriate lawful basis and with appropriate safeguards.

15. Marketing communications

You may opt out of marketing emails at any time using the unsubscribe link or by contacting [email protected]. Transactional and service communications relating to your Account, purchases, security, and legal notices are not marketing and may still be sent.

16. Children’s privacy

The Services are not directed to children, and we do not knowingly collect Personal Information from anyone under 18 years of age, or under 13 (or the applicable minimum age in your jurisdiction). If we learn that we have collected such information, we will delete it. If you believe a child has provided us information, contact [email protected].

17. Third-party links and services

The Services may link to or integrate with third-party websites and services that we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.

18. Data breach and incident response

We maintain a security incident-response process for detection, containment, investigation, notification, and recovery. Where a personal-data breach is likely to result in a risk to your rights, we will notify affected individuals and the relevant authorities as required by applicable law.

19. Changes to this policy

We may update this Policy from time to time. The "Last Updated" date reflects the most recent revision. We will communicate material changes by reasonable means. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Policy, to the extent permitted by law.

20. Additional U.S. state disclosures (categories)

For transparency under U.S. state privacy laws, the categories of Personal Information we may collect are: identifiers (such as name, email, IP address, and account and platform usernames); commercial information (purchases and billing metadata); internet and network activity (usage and device data); approximate geolocation (from IP); audio or electronic information (support and AI communications); professional or affiliate information (payout and tax details); and inferences drawn from the foregoing. We collect these categories from you, your devices, and the third-party sources described in Section 3, and disclose them for the business and commercial purposes described in Sections 4 and 7.
